Terms and conditions

General
No order will be deemed to constitute a contract of sale irrespective of the manner of its transmission to the Seller until the Goods are despatched by the Seller.

General note on product descriptions and images
Please note that many of our products are natural and often handmade, therefore please be aware that the size and shape of gemstone pieces may vary and selected products may differ in colours and shape from the images published on our web site.

Prices
All prices displayed include VAT.
The price payable shall be that displayed at the time of ordering.
All prices are shown in GB Pounds Sterling.  The Crystal Store does not accept liability for non-UK customers assuming that prices are shown in any currency other than GB Pounds Sterling. A currency converter for Euro’s and US dollars is available for such customers, so they can convert the value of their order to these currencies. Your own bank/credit card company will convert the value of your order from GB Pounds Sterling (as shown in your order confirmation email) to your own currency at the time the transaction is processed. The Crystal Store has no control over the currency conversion rate your bank/credit card company uses.

Delivery
The Seller shall not be held liable for any losses, expenses or consequential loss incurred by the Buyer or any other person or company however arising whether directly or indirectly out of a failure to meet an estimated delivery date.

Payment
Payment by cash, cheque or credit card is due at the time of order.
Goods remain the property of the Crystal Store until fully paid for.

Product Guarantee
Products sold by The Crystal Store are guaranteed against defects in material and workmanship for a period of one year. Please note we cannot accept responsibility for damage resulting from misuse.

Returned Goods
Notification of damage, faulty, wrongly shipped goods or incompletely shipped goods must be made within 14 days of delivery. Any claim made outside of 14 days will not be accepted. Please notify us by email within 14 days of receipt and we will give you instructions on how to return the faulty item.
The Buyer will be liable for the cost of remedying damage to returned goods where such damage has in the opinion of the Seller been caused by the goods being inadequately packaged by the Buyer.

The Seller's failure to insist upon strict adherence to any of the terms and conditions with this contract shall not be deemed a waiver of its rights within these terms and conditions.

Right to Cancel
Under The Consumer Protection (Distance Selling) Regulations 2000 (Regulation 11, point 2), customers have the right to cancel within 14 working days from the date of the order for any reason and return the items to receive a refund or exchange of the goods, less delivery. Goods must be returned in their original packaging, unused and in a resalable condition. A refund will not be given if the items arrive damaged as a result of the original packaging not being used, in these cases the items will be returned to you. The Crystal Store will not accept liability if returned items are lost in the post on their way back to us and cannot therefore issue a refund/exchange in those circumstances, therefore we strongly advise you to send any returns by a traceable postal method. Under no circumstances are we able to accept the return of earrings, in compliance with current Health & Hygiene regulations. Where a refund is given, it will be made within 30 days of receiving the returned item/s and will be refunded to the original card used.

Unable to supply goods
If for whatever reason we are unable to supply you with your order we will notify you immediately and refund the amount to the original method of payment given.

Faulty Goods
Should any item prove faulty or be damaged in transit, Items should be returned within 30 days of notification, returns sent after this time will not be accepted. Upon receipt of items returned as faulty, The Crystal Store will arrange for an exchange. The Crystal Store’s decision is final.

Acceptance of Goods
You are deemed to have legally accepted your items by keeping them, after you've had a reasonable time to examine them (i.e. without notifying us of any fault within 30 days of the purchase date). Refunds or exchanges after 30 days from the purchase date cannot therefore be considered. Further information on your rights as an internet consumer can be seen at Consumer Direct.

Non-Delivery
If Recorded Delivery items within the UK and International Signed For / Airsure Delivery items outside of the UK cannot be delivered to the customer, are not collected from their local post office and therefore returned to us, the items will be returned into stock and a refund will be given less delivery. In these circumstances if the customer requires re-delivery they should re-order the items.

Limit of Liability
Although the products sold by The Crystal Store would be considered harmless by most people, we have no control over what you do with them or how you use them once you receive them. We therefore hereby specifically disclaim all liability for any loss, damage, injury or other negative consequence in whatever form, howsoever caused, which arises from the use (or indirect use) of any product advertised on, or supplied via the Crystal Store website. Furthermore, no guarantee can be, nor is given, with regard to any spiritual or metaphysical qualities for any of the products we supply.

Healing Properties
The healing properties mentioned on the Crystal Store site in relation to gemstones represent views expressed in the public domain.  The Crystal Store have not undertaken any scientific studies to verify their validity. The healing properties of gemstones should never be relied upon as the only course of treatment in the case of illness. In particular gemstones should never be used as an alternative to conventional treatments and medicines.

Legal Liability
The contracts from the sales of goods by The Crystal Store shall be subject to and governed by English law.
Liability of The Crystal Store shall in no circumstance exceed the original value of the price charged for the goods. HolisticShop.co.uk cannot accept liability for injury or negative consequence of using the products it sells.

Wholesale
We do not supply to the wholesale trade, party-planners nor e-bay purchasers and we do not offer bulk terms/discounts. The Crystal Store reserves the right to refuse any order or limit product quantities in any order.

Acceptance of terms
By placing an order with The Crystal Store you are agreeing to be bound by our terms and conditions.
